PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT THAT WAIVES SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. BY REGISTERING, SIGNING, OR PARTICIPATING, YOU AGREE TO ALL OF THE TERMS BELOW ON BEHALF OF YOURSELF, YOUR DOG, AND ANY MINOR YOU REGISTER.
"Event" means Mutts, Mud & Mayhem and all related activities, including the obstacle course, the 5K route, the kids fun run, the finish-line festival, and any pre-event or post-event activity. "Released Parties" means Ridgeside K9 Eastern Carolina LLC, K9s United, Topsail Island Brewing Company, and each of their respective owners, officers, members, employees, agents, contractors, volunteers, sponsors, vendors, the property owners and lessees of the event grounds, and all other organizers and their successors and assigns. "I," "me," and "my" mean the participant and, where the participant is a minor or a dog, the parent, legal guardian, or dog owner signing this agreement.
I understand that the Event is a physically demanding outdoor obstacle race involving running, climbing, crawling, jumping, mud, water, uneven and slippery terrain, man-made and natural obstacles, large numbers of people and dogs, and changing weather. I knowingly and freely assume all risks, both known and unknown, of participating, even if arising from the negligence of the Released Parties, and I assume full responsibility for my participation and that of my dog.
These risks include, without limitation: slips, trips, and falls; sprains, strains, broken bones, concussion, cuts, drowning or near-drowning, hypothermia, heat exhaustion, heat stroke, cardiac events, permanent disability, and death; contact with other participants, dogs, equipment, or obstacles; dog bites, scratches, and other animal-related injuries; exposure to mud, water, insects, allergens, and the elements; and damage to or loss of personal property. I acknowledge these risks may be caused by my own actions, the actions of others, the condition of the grounds or equipment, or the conduct of dogs present.
To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue the Released Parties from and for any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, illness, or death that I or my dog may suffer, or that I may cause to any other person or property, while participating in or present at the Event, including any claim based on the ordinary negligence of the Released Parties. This release applies to claims I have now or may have in the future.
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) brought by me, my dog, my family, my estate, or any third party, arising out of or related to my participation, my dog's conduct, or my presence at the Event. I am solely and fully responsible for any injury, damage, or loss caused by me or by my dog.
I attest that I am physically fit and capable of safely participating, that I have no medical condition that would make participation dangerous, and that I am not under the influence of alcohol or any substance that impairs my ability to participate safely. I assume all risk related to my physical condition and that of my dog.
I consent to receive first aid and emergency medical treatment if needed, and I authorize the Released Parties to obtain emergency medical or veterinary care for me, my minor child, or my dog if I am unable to consent. I am responsible for all costs of any medical or veterinary treatment, transport, or care, and I release the Released Parties from liability for providing, arranging, or failing to provide such care.
I understand the Event takes place rain or shine and may be delayed, modified, shortened, or canceled for weather, safety, or other conditions, including a heat-safety cutoff for the protection of the dogs. Obstacles and the course may change. Registration fees are non-refundable and non-transferable except as expressly stated by the organizers in writing.
I grant the Released Parties the irrevocable right to photograph and record me, my minor child, and my dog at the Event, and to use those images, video, name, voice, and likeness in any media, for promotion, marketing, fundraising, and any lawful purpose, without compensation, notice, or approval.
I understand the Event is a fundraiser benefiting K9s United and that registration is an event fee, not a tax-deductible charitable donation, except to the extent, if any, confirmed in writing by the organizers or K9s United.
I agree to follow all event rules, course markings, and the instructions of staff and volunteers, to compete honestly, and to treat other participants, dogs, staff, and the venue with respect. Failure to do so may result in removal without refund.
This agreement is governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, and any dispute will be brought exclusively in the state or federal courts located in Pender or Onslow County, North Carolina. If any provision of this agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be enforced to the greatest extent permitted by law.
This is the entire agreement between me and the Released Parties regarding the Event and supersedes any prior understanding. I have read this waiver, fully understand its terms, understand that I am giving up substantial rights including the right to sue, and sign it freely and voluntarily. I agree that checking the agreement box and submitting my registration constitutes my legal electronic signature under the federal E-SIGN Act and North Carolina law, and that a timestamp and IP address recorded at submission serve as evidence of my signature.
If I am registering or signing for a participant under 18, I am that participant's parent or legal guardian, I consent to their participation, and I agree to every term of this waiver on their behalf, including the assumption of risk, release, and indemnification, and I release the Released Parties from any claim brought by or on behalf of the minor.
